1. Acceptance of Terms

- 1. This is a registration form to be an affiliated customer.

2. Any adult person is eligible to become a customer on purchasing the products of the company by applying through the affiliate form, directly or through associate of the company. The members will be called Associate only and if they help others to purchase any one or more products of the company then associate will receive commission / bonus.

3. Any Indian National irrespective of caste, race or religion is eligible to become on independent associate of the company.

4. Any individual above 18 years of age can become an independent associate. If underage, his/her guardian should sign the form.

5. Participation in this business plan is purely voluntary.

6. The applicant should read and understand the policies and procedures, code of ethics, the business opportunity from the website: - www. Kanakherbal.in This Application / Agreement form is considered as an authentic and binding legal document and together with the above forms the entire contact between the applicant and the company.

7. The applicant should adhere and abide by the said rules of business / company including the amendments made by the company from time to time.

8. The company will rely on the accuracy of the application forms submitted in its data processing. The applicant should ensure that all information is correct and properly entered.

9. All applicants who will promote the products of the company are eligible to receive commission / bonus from the company and they can also introduce new associates to expand his / her network according to the company’s marketing plan.

10. The company has sole discretion to accept or reject any application without assigning any reason.

11. The person authorized by the company will explain the business of the company.

12. The company reserves the right to retain the application form and documents provided there with, and will not return the same.

13. Independent associate hereby confirms that he / she has entered into this agreement as a principal to principal relationship. Nothing in this agreement shall establish an employee - employer relation between the parties. The associate is not authorized to incur any debt, expense account on behalf of / for or in the name of the company. He / she will be solely responsible for paying all expenses incurred by him / her for day to day operation. All the direct, indirect expenses incurred towards use / misuse / inability to properly use / misuse / inability to properly use the product / services are to be borne by the independent associate only.

14. The associate shall not compel or induce or mislead any person with any false statement / promise to join the company or to purchase any product.

15. Incomplete and unsigned form shall not be accepted.

16. The associate can not bind the company in any way nor imply that he has an authority to bind the company or to speak on its behalf.

17. The company reserves the right to amend / modify the plan, rates, prices or terms and condition from time to time and the same will be applicable to all independent associates and it will be assumed that all independent associates agree to it and would abide by such changes and undertake complete responsibility to stay abreast of such developments in such a fashion.

18. The associate will be eligible for incentive / income / bonus only as per the volume of business done by him that is also subject to the eligibility norms formulated by the company does not assure any incentive / income / bonus to the associate on merely or income to the associate on merely account of his / her joining the company.

19. The initial payment made by the applicant is towards enrolling as an independent associate.

20. The company will not entertain any kind of refund in regard to product amount paid by independent associate under any circumstances what so ever. Instead they shall pay the balance amount and collect product service desired.

21. Product will be issued after receipt of full and final payment.

22. The joining date shall be the date on which application was accepted by the company’s computer system.

23. Company is not responsible if the payment made does not reach company’s office.

24. The computer does not issue any kind of units share, certificate or debentures.

25. All independent associates are required to indemnify and hold the company harmless against all claims made by them and the third party and any related damages and expenses arising out of or connected with conduct of the independent associate or services rendered by him or any liability which might have arisen due to violation of these terms and condition by the concerned associate.

26. Membership can be transferred to any person on written request to the company along with a payment of Rs. 1000/= as transfer fee.

27. The company with not issue any payment for less than Rs. 300/=. This amount will be accumulated and paid with the next payment whenever the amount is more than Rs. 300/=.

28. The company has sole discretion and power to use the name logo and trademark as designed by the company. An associate can use these symbols logo for the promotion of business of the company.

29. The company has right to terminate any business associate without giving any prior notice.

30. TDS (Tax Deducted at Source) shall be deducted as per provision of IT Act 1961 as applicable from time to time. Necessary TDS certificate shall be issued by the company. However, independent associate shall be solely responsible to comply with all statutory provisions of law and taxation, central or state level as may be applicable. TDS certificate will be issued only after receiving pan (Permanent Account Number).

31. Upon death of the independent associate, the right and responsibilities of the independent associate are passed on to the rightful nominee as per the law. The nominees shall be bound by the terms and conditions of the original independent Associate agreement and abide by the company’s rules and regulation.

32. The company shall not be responsible for interruption in its service by acts of God, natural calamities such as floods, fixes, typhoon, hurricane, storm or circumstances beyond its control like computer breakdown, strikes, lockouts, etc.

33. All the payments will be subject to all application taxes and other tax with holding duties and levies.

34. In compliance with the terms of this agreement, company may at its discretion, take strict disciplinary action against the concerned associate. The pendency may also impose upon him as the penalty. In case such an action is initiated against the said associate, he / she shall not be entitled to receive any future incentives, who there or not the sales for such incentives have been completed. If this agreement terminated for any reason whatsoever, the concerned associate will lose his right (Present and Future) as an associate and rights to compensation including incentives receivable pursuant to the company’s business plans.

35.Goods once sold shall not be taken back.

36. Working closing will be done on day to day basis.

37. In case of any dispute, the company’s decision will be final and binding.

38. All disputes shall be subjected to KANPUR jurisdiction only.

39. The associate shall be entitled to earn incentive / bonus by helping others to become an associate of the company.

40. Associate shall be entitled for incentive / bonus only on enrolment of new members through his / her reference. The incentive shall be credited to the associate’s Bank A/c, as per the business plan of the company.

41. We are making profits from the products and these profits are invested and further sharing with our associates.

42. If receipt has not been received within 3 days. Kindly contact your sponsor or the company.

43. An individual will be issued a unique ID No.

44. Associate is not a company employee.

45. I hereby confirm that the particulars given herein above are all true and correct.

46. I am enclosing herewith my one photograph in color for your record.

47. The associate shall not misrepresent the company regarding the product or performance of the company.

48. The company shall not be responsible for any delay and failure in performance which is beyond the control of the company or through change in Government Policies.

49. All the above terms and condition are acceptable to the members and the same are binding upon the kanak associate and the company both.

The company reserves the right to terminate membership for violation of terms.
